Right to be forgotten provisions have long been criticized for not really applying to the global internet. This interpretation has grown even more troubling, as it means Google and other search engines will be blocking access to some of the world’s most important information.

Simply because it’s been flagged as possibly relevant to people’s lives. Google said today that it’s working with three organizations — the Internet Society, Access Now, and European Digital Rights — to “ensure Google makes good on the commitments it has made.

Data Protection

Choking off communication: If Europe pulls its data protection laws, this will be a big deal for global internet users. In a 2011 report, the European Commission said the ‘right to be forgotten’ could create problems for the search engines it regulates.

And Google would no doubt be among them. After all, it’s got so much information on people, and often those records may be potentially crucial for political activism or civil cases. Google has said it plans to comply, but it’s not yet clear what the web giant has in mind.

Legal Experts

Legal experts say there are important questions — the first of which is whether it’s even possible to remove content from the world wide web. The Court of Appeal considers that the Tribunal of the. European Union has made two errors in finding that the data subject may have the right to unilaterally cancel the caching of the search results concerning.

Concerning

The Court first considers that if the right of the data subject to cancel the caching of search results is rescinded, he will be able to completely delete the records concerning him from the search engine’s search history, thereby enabling him to act effectively as he wishes.

Search Results

For the applicant to be delete given that the search result was, at that stage, only possible as a provisional order. The Court does not take account of the fact that he accepted the transmission of the information to the search engine because he believed that he would get a better result on his query.

The Court consider that, as stated by the Advocate General, such a reaction would be consistent with the goal of maintaining the search results’ information in general, while the situation of the applicant would not have been restore.
